Please carefully read the terms and conditions of use for this website presented below. Your access/visit to this website is subject to the terms and conditions of use, implies your explicit acceptance regarding this and represents the entire understanding (contract) between the parties.

The company S.C. EZADA Trade S.R.L. with headquarters in Sântion, Șos. Borșului, No. 80, Bihor County, registered with the Trade Registry under no. J05/106/18.01.2018, having unique registration code RO38712251 from 15.02.2018, directly administers the online store www.tiptoptoys.ro. The content of images, texts, web graphics elements, scripts and other data present on this site cannot be reproduced, modified, transferred, published, displayed, transmitted or recorded without the prior written consent of S.C. EZADA Trade S.R.L. This is the property of S.C. EZADA Trade S.R.L. and is protected by copyright law. The information presented may include technical inaccuracies or typing errors.

The company S.C. EZADA Trade S.R.L., beneficiary of the website www.tiptoptoys.ro, operates only as an online store. All prices displayed on the site include VAT.

S.C. EZADA Trade S.R.L. reserves the right to make changes to these terms and conditions, as well as to the site structure, without prior notification and without specifying the reasons.

Products on this site are offered within the limit of available stock. No compensation can be claimed in case the order cannot be fulfilled for justified reasons (lack of product in stock or supplier stock, possible printing errors, etc.). In these cases, www.tiptoptoys.ro will notify the customer about the problems that have arisen and will cancel the order. Regarding product quality, brand authenticity and any other clarifications regarding a particular brand or product, the customer can contact the importer or the www.TipTopTOYS.ro store.

The images presented on the site are exemplary; products may differ from these in terms of color, appearance, etc., but in such situations the customer will be notified before the order is sent and it will only be sent with their consent. The characteristics and availability of products presented on this site may change without prior notification. In case prices or other details regarding products have been displayed incorrectly, including due to the fact that they were incorrectly entered in the database, TipTopTOYS.ro reserves the right to cancel the delivery of that product and notify the customer as soon as possible about the error that occurred. The conclusion of the sale-purchase contract takes place at the time of issuing the fiscal invoice (this document serves as a contract according to Romanian legislation) and not when placing the order or when sending by email (or other means of communication) the automatic confirmation of receipt of the order.

PRODUCT DELIVERY

The shipment of products ordered from the site is made immediately after the order has been processed and prepared for packaging by the TipTopToys.ro team. From the moment of order confirmation, you will be contacted by email or phone and thus you will receive the AWB number, having the possibility to track where your package is directly on the courier company's website.

The duration of product shipment depends on the available stock. Normally within 1-3 working days from written confirmation of the order, if the respective product is in stock. If for certain reasons the product is not in stock, an operator will communicate by phone or email the shipment duration of the ordered products.

Payment can be made online with a bank card or cash on delivery; in this case, money collection will be made by the agent who delivers the products to you. The value of the products is that from the moment of confirmation of processing by email.

Orders placed online Friday after 4:00 PM until Sunday will be processed on Monday of the following week.

Product delivery is made through FAN Courier, Romanian Post or personal delivery in Oradea and its periphery.

FREE DELIVERY

All orders exceeding 500 RON benefit from FREE DELIVERY! If your order is worth 500 RON or more, transport is covered by our company (through FAN Courier, CARGUS, Romanian Post or personal delivery in Oradea and its periphery).

TRANSPORT COSTS

1. FAN Courier (without exterior KM) - online card payment:

If your order has a value less than 500 RON and you make online payment with a bank card, the transport fee is 15.90 RON with VAT regardless of package weight. If there is no FAN Courier office in the delivery locality, an additional fee of 1.00 RON with VAT/exterior KM will be charged or the package shipment will be modified through Romanian Post with similar benefits from the order.

To track the shipment status, access the courier's website (www.fancourier.ro) and use the AWB number from the confirmation email or SMS (ex.: AWB xxxxxxxxx01).

Package delivery by express courier will be made within 24-48 hours from its shipment (except Sundays and legal holidays). Delivery is made Monday to Friday between 9:00 AM – 5:00 PM, and Saturday between 9:00 AM-2:00 PM (if the courier company makes deliveries in your locality on Saturday as well). If you are not home during this interval, please specify another address (work address) to avoid delays regarding delivery or even non-delivery of ordered products.

2. FAN Courier (without exterior KM) - cash on delivery payment:

If your order has a value less than 500 RON and you make cash on delivery payment to the courier agent, the transport fee is 21.90 RON with VAT regardless of package weight. If there is no FAN Courier office in the delivery locality, an additional fee of 1.00 RON with VAT/exterior KM will be charged or the package shipment will be modified through Romanian Post with similar benefits from the order.

To track the shipment status, access the courier's website (www.fancourier.ro) and use the AWB number from the confirmation email or SMS (ex.: AWB xxxxxxxxx01).

3. FAN Courier with opening at delivery (without exterior KM) - online card payment:

If your order has a value less than 500 RON and you opt for the CHECK ON DELIVERY service (opening at delivery) and make online payment with a bank card, the transport fee is 19.90 RON with VAT regardless of package weight. If there is no FAN Courier office in the delivery locality, an additional fee of 1.00 RON with VAT/exterior KM will be charged or its shipment will be modified through Romanian Post with similar benefits from the order.

CHECK ON DELIVERY characteristics (opening at delivery):

Offers the possibility to open the order at delivery and visually check, within maximum 1 minute, if the ordered products are appropriate.
Technical verification/testing at destination is NOT permitted!
Available for both natural and legal persons.

To track the shipment status, access the courier's website (www.fancourier.ro) and use the AWB number from the confirmation email or SMS (ex.: AWB xxxxxxxxx01).

4. FAN Courier with opening at delivery (without exterior KM) - cash on delivery payment:

If your order has a value less than 500 RON and you opt for the CHECK ON DELIVERY service (opening at delivery) and make cash on delivery payment, the transport fee is 25.90 RON with VAT regardless of package weight. If there is no FAN Courier office in the delivery locality, an additional fee of 1.00 RON with VAT/exterior KM will be charged or its shipment will be modified through Romanian Post with similar benefits from the order.

CHECK ON DELIVERY characteristics (opening at delivery):

If your order has a value less than 500 RON and you make cash on delivery payment to the courier agent, the transport fee is 21.90 RON with VAT regardless of package weight.

To track the shipment status, access the courier's website (www.cargus.ro) and use the AWB number from the confirmation email or SMS (ex.: AWB xxxxxxxxx01).

7. Romanian Post (parcel service with pickup from post office) - online card payment:

Delivery through Romanian Post (parcel service with pickup from post office) is made to any locality in Romania. Your order package will be picked up from the post office to which you belong. The delivery cost is 15.90 RON with VAT regardless of package weight if you make online payment with a bank card. From the moment of shipment confirmation, the delivery term for the package/order is 1-4 working days. To eliminate surcharges for exterior kilometers applied by express courier companies, Romanian Post is the most suitable alternative for order delivery in rural areas.

8. Romanian Post (parcel service with pickup from post office) - cash on delivery payment:

Delivery through Romanian Post (parcel service with pickup from post office) is made to any locality in Romania. Your order package will be picked up from the post office to which you belong. The delivery cost is 21.90 RON with VAT regardless of package weight if you make cash on delivery payment at the Romanian Post counter. From the moment of shipment confirmation, the delivery term for the package/order is 1-4 working days. To eliminate surcharges for exterior kilometers applied by express courier companies, Romanian Post is the most suitable alternative for order delivery in rural areas.

9. Personal delivery in Oradea and its periphery (payment with bank card through POS terminal):

This delivery option is offered exclusively to customers from Oradea and its periphery; the transport fee is 9.90 RON with VAT regardless of package weight. Having our headquarters in the vicinity of Oradea municipality, we want all customers in the area to benefit from fast and correct delivery offered by the TipTopTOYS.ro team with payment option: bank card payment at delivery through POS terminal. This type of delivery offers the possibility of checking the order at delivery and verifying that the product/products correspond to those presented in our online store. An operator will contact you by phone to establish a time interval for order delivery to the address mentioned by you.

10. Personal delivery in Oradea and its periphery (online card payment):

This delivery option is offered exclusively to customers from Oradea and its periphery; the transport fee is 9.90 RON with VAT regardless of package weight. Having our headquarters in the vicinity of Oradea municipality, we want all customers in the area to benefit from fast and correct delivery offered by the TipTopTOYS.ro team with payment option: online bank card payment. This type of delivery offers the possibility of checking the order at delivery and verifying that the product/products correspond to those presented in our online store. An operator will contact you by phone to establish a time interval for order delivery to the address mentioned by you.

PRODUCT RETURNS

According to Romanian legislation (Government Emergency Ordinance number 34/2014), you can return products purchased from TipTopToys.ro within 14 calendar days from their purchase.

The product can be returned under the following conditions:

must not show signs of assembly
packaging, labels and accessories must be intact
must not show signs of use

The product must not be used outdoors and must not show signs of use or assembly! If the product does not meet customer requirements, we recommend avoiding its use and assembly. In case of product refusal, please contact us within 48 hours of receiving it by phone or email to establish details regarding the return. The legislation in force applies to natural persons. Therefore, you, the consumer, have the right to unilaterally denounce the distance contract within 14 working days, without penalties and without invoking any reason. The only costs that may fall on you, the consumer, are the direct expenses of returning the products and initial shipping costs in case your order benefited from free delivery. In other words, if you want to give up a product, you must send us a notification by email or fax by which you give up the product or complete the return form.

In case you want to return the product purchased from the online store where you benefited from free transport, you will have to pay the initial delivery fee as well, which was covered by our company, since the return is not made due to our fault; return fees may differ depending on your choice of courier company.

The product can be returned only if it is in perfect condition (including packaging) and shows no signs of wear. Return expenses will be borne by the customer, and reimbursement of the product's value will be made within the legal term of 14 days. If the returned product is damaged, has clear signs of use and cannot be sold as a new product, we reserve the right to refuse the product. All these clauses and conditions are provided in Government Emergency Ordinance No. 34/2014 regarding the legal regime of distance contracts.

DEFECTIVE PRODUCTS RECEIVED

In the event that the purchased product is non-functional or has manufacturing defects from the moment of receipt, it will be replaced with a functional product, provided written and telephone notification to S.C. EZADA Trade S.R.L. If S.C. EZADA Trade S.R.L. cannot replace the product with an identical one, the product's value will be refunded.

GENERAL RETURN CONDITIONS

Products that do not conform to specifications on the site from the moment of order shipment can be returned without involving additional costs from the customer, following a written notification specifying the nature of the non-conformity. The customer can request return of the product's value or replacement with a conforming one. If S.C. EZADA Trade S.R.L. cannot replace the product with a conforming one, the product's value will be refunded.

Note: For products whose packages show visible damage upon receipt by courier, the buyer is asked to refuse their reception. If the received product has an aesthetic defect, it is necessary to report it in writing to the courier company (preparation of the Verbal Process is mandatory) and within maximum 24 hours from product delivery, to the electronic address contact@tiptoptoys.ro, together with 2-3 representative photos illustrating the defect.

WARRANTIES

All products sold on the website www.tiptoptoys.ro have the warranty offered by the manufacturer of the respective product. The warranty is resolved at the headquarters of S.C. EZADA Trade S.R.L. presented on the contact page by S.C. EZADA Trade S.R.L., through repair or replacement of the defective product. Payment of transport for products sent (round trip) for warranty resolution is the responsibility of S.C. EZADA Trade S.R.L., and shipment will be made through the express courier Fan Courier. Warranty resolution is done within maximum 15 calendar days.

Products that have physical defects such as: blows, cracks, chips, burned or cracked components/parts, etc., damaged, removed or modified warranty labels or seals, products used in inadequate conditions (inappropriate supply voltages, subjection to large temperature and pressure variations, mechanical shocks, incorrect handling, use of products in humid conditions, dust, noxious substances or under the action of chemical substances, etc.), incorrect settings and installations, sockets without grounding, penetration of liquids, metals or other substances inside equipment, mechanical or plastic intervention on products, connection or disconnection of certain components during equipment operation are not covered by warranty.

The TipTopToys.ro team assures you of total involvement in resolving any problems that arise with certain products due to unknown causes or that do not depend on us.

S.C. EZADA Trade S.R.L. conducts discount and promotion campaigns for imported or distributed products. The merchant has no obligation to announce the organization of these campaigns in advance. The merchant offers its customers the possibility of free subscription to the newsletter service where they can be notified in advance of the existence of discount campaigns.

ONGOING PROMOTIONS

The period during which these promotions or discounts take place may be changed without prior notice depending on available stock. Promotional campaigns conducted on TipTopToys.ro regarding product price reductions have limited validity and are delivered within the limit of available stock. Discounts are made in collaboration with suppliers or product importers, have limited duration and different discount percentages depending on the manufacturer, within the limit of available stock. The discount will be appropriately signaled by displaying both the full price and the reduced price. Delivery will be made by express courier within 2-3 working days from order confirmation, except Sundays and legal holidays. There may be exceptional situations when the ordered product is no longer in the supplier's or importer's stock at the time of order. If a discounted ordered product is no longer in stock at the time of order, it can be brought to order within maximum 30 days within the limit of available stock from the manufacturer. The price of products brought to order may change compared to the price displayed at the time of placing the order, a situation that will be brought to your attention by our operators regarding the change in delivery term and/or price change.

The fiscal invoice will be sent in printed format together with the ordered product/products but also in electronic format (Law 571/2003) to the email address provided, without requiring stamping and signing. In case the customer did not receive the fiscal invoice in printed format, they can request it at any later time, signed and stamped, if the performed activity requires this (legal person) or simply if it is desired to keep the invoice in printed format.

PRODUCTS REQUIRING PRE-ORDER

For products that are not in stock and require a pre-order, payment of a 30% advance from the total order value is required in the displayed account of S.C. EZADA Trade SRL, after which, before package shipment, the difference up to the full amount must be paid. Delivery of products requiring a pre-order may take 7-21 working days. Payment will be made based on the advance invoice and the final invoice issued to you by S.C. EZADA Trade SRL.

COOKIES AND THEIR USE

Cookies are pieces of text used by your browser to store some information on your system's magnetic unit. Each cookie can only be read by the web server that generated it. Cookies cannot transmit information from your magnetic unit.

9. SECURITY AND PRIVACY ISSUES
